Terms of Use

1. Application and Acceptance

These Terms set out the conditions for general use of the HolistiCare website and apply to the extent enforceable under applicable law. If you do not accept the applicable conditions, discontinue website use.

Ordinary browsing does not, by itself, create a clinical, employment or rental relationship, authorize a payment or provide consent to treatment or optional information uses.

Where a transaction requires agreement, its material terms are presented through the relevant agreement or booking process. Any required acceptance must be obtained through that process rather than inferred solely from browsing.

You may act for another person only within your actual legal authority. Information you submit must be accurate to the best of your knowledge and must not intentionally misrepresent identity, credentials or decision-making authority.

Children and youth may read public information. Legally significant requests and decisions must be made by a capable individual or an appropriately authorized representative, as applicable.

2. Website Purpose

The website provides general information about HolistiCare, services, programs, opportunities and contact methods. It helps visitors decide whether to inquire; it does not determine individual suitability or establish acceptance into a service.

These Terms do not replace service agreements, informed consent, information-sharing authorizations, clinical or safety plans, employment or contractor agreements, or legal and professional obligations.

3. No Individualized Clinical Advice

Public content is informational and educational. Unless expressly provided within an established professional relationship, it is not an assessment, diagnosis, prescription or individualized medical, psychological, behavioural, speech-language, occupational-therapy or other clinical recommendation.

Do not delay qualified care because of website content. Visiting the website, emailing HolistiCare or submitting a general form does not alone establish a professional relationship.

4. Professional Services

Regulated services must be delivered or supervised by appropriately qualified and authorized professionals in accordance with their lawful scope, competence and applicable standards.

The title “Behaviour Analyst” is restricted in Ontario. References to Registered Behaviour Analysts refer to individuals registered with the College of Psychologists and Behaviour Analysts of Ontario. BCBA or BCBA-D certification does not replace required Ontario registration.

A reference to a profession, resource or independent practitioner does not establish that HolistiCare currently offers that service. Availability must be expressly confirmed.

Assistants, technicians, tutors and other unregulated personnel must not misrepresent themselves as regulated professionals or work beyond their qualifications and authorized role.

Services may require intake, suitability review, identified professional and record arrangements, informed consent, a service agreement, and confirmation of fees, funding and scheduling before commencement.

5. Funding and Ontario Autism Program Information

Information about the Ontario Autism Program (“OAP”), AccessOAP, insurance or other funding is general guidance. Eligibility, invitations, allocations, eligible expenses, reimbursements and reporting requirements are determined by the responsible program administrator or insurer.

HolistiCare does not guarantee funding, reimbursement, program acceptance or that every service, activity or fee is eligible. A clinic listing, provider reference or program name does not establish eligibility for every expense.

Confirm current requirements before committing funding. Official OAP information is available through the Government of Ontario. Written service terms identify the parties’ agreed billing responsibilities without overriding applicable law.

6. Availability, Suitability and Outcomes

Service, program, location and opportunity descriptions do not guarantee immediate availability. Availability can depend on individual suitability, qualified personnel, supervision, schedules, enrollment, operational capacity, funding and safety requirements.

Outcomes vary. HolistiCare does not promise a particular clinical, developmental, educational, employment or funding result. Examples and testimonials are not guarantees of another person’s outcome.

These statements do not remove any duty to provide accepted services competently or comply with an applicable agreement.

7. Forms and Communications

A submitted inquiry permits HolistiCare to respond and handle relevant information under the Privacy Policy and applicable lawful authority. It does not provide unrestricted consent to treatment, external disclosure, recording or promotion.

A form submission does not guarantee acceptance, enrollment, an appointment, interview, assignment or response time. A request or automated acknowledgement is not a confirmed booking unless expressly identified as a confirmation.

Do not submit detailed clinical records, identification, SINs or banking information through ordinary forms or email unless requested through an approved method.

Internet communications can be delayed, intercepted or misdirected. Use accurate contact information and advise us if a contact method is not private. These risks do not remove HolistiCare’s safeguarding obligations.

8. Virtual Services

Virtual or hybrid services require professional suitability and applicable consent. Participants may need a reliable connection, suitable device, private setting, required support person, current location and emergency contacts, and a technology-failure plan.

The responsible professional must have lawful authority to serve the client in the client’s actual jurisdiction. Moving or travelling may affect whether a session can proceed.

These Terms do not authorize recording, establish an emergency plan or automatically approve virtual delivery as a substitute for an in-person service. Third-party outages cannot be completely prevented; HolistiCare remains responsible for duties within its control.

9. Careers and Applications

Postings may describe an existing opportunity or invite interest in future opportunities, as identified in the posting. Applying does not guarantee an interview, offer, engagement, compensation amount, minimum hours or assignments.

Engagement depends on qualifications, professional standing, operational requirements and the actual relationship. A contractor label does not determine legal classification.

Applicants must provide truthful information. Relevant verification is undertaken at an appropriate stage with required consent or other lawful authority. Accommodation requests may be made without retaliation.

10. Intellectual Property

Unless otherwise identified, original website content, branding, graphics, materials and layout are owned by or licensed to HolistiCare and protected by applicable intellectual-property law.

You may view, download or print a reasonable amount for lawful personal, informational and non-commercial use.

Except as permitted by law or written authorization, you must not commercially exploit substantial content, remove ownership notices, create misleading copies, or use HolistiCare branding to suggest an unauthorized affiliation or endorsement.

Automated extraction must not unlawfully access information or materially interfere with website operation. Nothing here limits legally available fair dealing or other statutory rights.

11. Acceptable Use

You must not use the website to:

• commit fraud, impersonate another person or misrepresent authority;
• submit information you are not authorized to provide;
• upload malware or circumvent access controls;
• interfere with operation or unlawfully access systems or information;
• conduct unauthorized intrusive security testing;
• harass, threaten or submit unlawful content; or
• collect information about others without lawful authority.

HolistiCare may reasonably restrict abusive access, preserve evidence and report suspected unlawful activity. This section does not prohibit good-faith complaints, lawful reviews, protected disclosures or exercising legal rights.

12. Third-Party Resources

Links may lead to government programs, regulators, research, booking or payment systems and other independent resources. A link does not imply endorsement or control unless expressly stated.

Independent services have their own terms and privacy practices. Review them before providing information. HolistiCare remains accountable for responsibilities it retains when using a service provider to perform a function on its behalf.

13. Operation and Security

HolistiCare takes reasonable measures to operate and protect the website. Continuous availability, error-free operation and absolute security cannot be guaranteed. Access may be temporarily limited for maintenance, security or other lawful operational reasons.

Visitors should protect their own devices, accounts and credentials. Report a suspected website vulnerability privately to info@holisticare.ca.

Do not publish client information or credentials. This request does not prevent lawful reporting to an authority or another protected exercise of legal rights.

14. Website Information

HolistiCare makes reasonable efforts to provide useful and accurate information. General content may nevertheless become outdated or contain errors. Contact us to confirm details material to a service or transaction.

The website does not guarantee that a particular service, professional, location or schedule is available, suitable for a person, or capable of producing a particular outcome.

This section does not override an express transaction confirmation, an accepted service obligation, or a warranty or remedy that cannot legally be excluded.

15. Responsibility and Legal Rights

These Terms do not provide a blanket release from negligence, privacy breaches, professional misconduct or another legal duty. Responsibility is determined under applicable law and relevant agreements.

HolistiCare does not control every visitor device, network or independent third-party resource. Such practical limitations do not excuse a failure to meet HolistiCare’s own obligations.

No general client indemnity, website-use damages cap, mandatory arbitration or waiver of a statutory complaint process is imposed through this page. Mandatory privacy, professional and applicable consumer protections remain available.

16. Privacy and Consent

Our Privacy and Confidentiality Policy explains information handling, privacy choices, access and correction, and complaint arrangements.

Reading or acknowledging that Policy, or using the website, does not by itself constitute consent to treatment, optional tracking, marketing, recording or disclosure requiring separate consent.

Applicable privacy law and valid purpose-specific consents govern information handling. These Terms do not waive privacy rights.

17. Accessibility

HolistiCare is committed to accessibility and accommodation in accordance with applicable human-rights and accessibility requirements.

Requests and complaints may be made without retaliation. This statement does not claim an independently verified technical certification.

18. General Provisions

Governing law

Ontario law and applicable federal Canadian law govern these Terms, without limiting mandatory rights or jurisdiction available under applicable law.

Severability and waiver

An invalid provision is limited or removed only as necessary. Remaining provisions continue to apply. A delay in enforcement does not permanently waive a right.

Other agreements

A separate agreement governs its particular subject matter. Where provisions conflict, the more specific applicable agreement governs that relationship, subject to law. Mandatory legal requirements prevail.

Transfers

Any corporate transfer of website rights or obligations remains subject to law and existing agreements. It does not automatically authorize transfer of clinical records or amendment of a signed agreement.

Headings

Headings assist navigation and do not change the meaning of a provision.

20. Updates and Previous Versions

HolistiCare may update these Terms to reflect website, operational or legal changes. Updates apply prospectively from their stated effective date. Required notice or affirmative agreement is obtained where applicable.

An update does not retrospectively alter accrued rights, amend a signed agreement by itself or supply consent required for a new information use.

Previous versions are retained for reference and may remain relevant to earlier website use or transactions, subject to applicable law and separately accepted agreements.

21. Bookings, Fees and Independent Room Rentals

A general description, price or displayed time invites an inquiry or booking request unless the relevant process expressly establishes a transaction. A request or acknowledgement does not confirm a booking unless expressly identified as a confirmation.

A confirmed booking is governed by the terms presented and accepted for that transaction and applicable law. These Terms do not cancel or override an express confirmation.

Material charges, applicable taxes, cancellation and refund arrangements must be disclosed through the appropriate agreement or booking process before commitment. Where applicable law requires transaction disclosures, an opportunity to correct errors, acceptance or delivery of an agreement copy, those requirements must be met.

This page does not independently impose treatment prepayment, a cancellation penalty, late interest or a payment-processing charge. Financial obligations arise through the applicable lawful agreement and accepted fee terms. A payment preference is not authorization for a pre-authorized debit or card-on-file charge.

An independent room renter remains responsible for their professional registration, services, insurance, consent, fees and records unless a separate lawful arrangement expressly provides otherwise. Rental alone does not create employment, partnership, HolistiCare supervision or endorsement, or make the practitioner’s clients HolistiCare clients.

Access, permitted use, equipment, shared-area privacy, safety, cancellations and damage responsibilities are governed by confirmed rental terms. Renting a room does not authorize practice outside lawful scope or competence.
