Terms of Use
These Terms of Use govern access to and use of holisticare.ca and its website features, information and forms.
These terms apply to website use only. Clinical, educational, employment, contractor and other professional relationships are governed by separate agreements, consent documents and applicable law.
1. Acceptance and Eligibility
By accessing or using this website, you agree to these Terms of Use to the extent enforceable under applicable law. If you do not agree, you should stop using the website.
You may use the website for yourself or, where legally authorized, in connection with a child, youth or another individual you represent. You must not claim to have decision-making or consent authority that you do not legally possess.
Children and youth may access publicly available website information. However, forms requesting services, consent or legally significant decisions should be completed by a capable individual or legally authorized representative, as applicable.
When submitting information, you agree to provide information that is accurate to the best of your knowledge and not intentionally false, misleading or fraudulent.
2. Website Purpose
This website provides general information about HolistiCare, its services, programs, professionals, employment opportunities and methods of contact.
Website content is intended to help visitors understand possible services and determine whether they wish to contact HolistiCare. It is not intended to assess an individual, establish clinical appropriateness or replace individualized professional consultation.
These Terms of Use govern the website. They do not replace:
- clinical or educational service agreements;
- informed-consent documentation;
- privacy or information-sharing authorizations;
- treatment, behaviour, education or safety plans;
- employment or independent-contractor agreements; or
- the legal and professional duties of regulated professionals.
3. No Medical or Clinical Advice
Public website content is provided for general informational and educational purposes. Unless expressly stated within an established professional relationship, it is not:
- medical, psychological, behavioural, occupational-therapy, speech-language, mental-health or other clinical advice;
- a diagnosis, assessment, prescription or individualized treatment recommendation;
- a representation that a particular service is appropriate for a specific person; or
- a substitute for consultation with an appropriately qualified professional.
Do not delay seeking qualified professional assistance because of information found on this website.
No clinician-client, therapist-client, patient-provider, teacher-student or other professional relationship is created merely by visiting the website, sending an email or submitting a general form.
4. Professional and Regulated Services
Where HolistiCare offers a regulated service, the service is delivered or supervised according to the qualifications, scope of practice and legal requirements applicable to the professional involved.
The title “Behaviour Analyst” is restricted in Ontario. References to Registered Behaviour Analysts are intended to refer to individuals registered with the College of Psychologists and Behaviour Analysts of Ontario. A BCBA or BCBA-D certification does not replace Ontario registration requirements.
Other regulated services—including occupational therapy, speech-language pathology, psychology, psychotherapy and social work—may be offered only when appropriately qualified and authorized professionals and operational capacity are available.
Support workers, supervised ABA therapists, behaviour technicians, educational staff, tutors, assistants and other unregulated personnel must not independently represent themselves as regulated professionals or provide services outside their qualifications and authorized role.
Before professional services begin, HolistiCare may require:
- an inquiry, consultation or intake process;
- confirmation of service appropriateness and capacity;
- informed consent and privacy documentation;
- a signed service agreement;
- professional assessment or authorization where applicable; and
- confirmation of fees, funding, scheduling and service conditions.
5. Ontario Autism Program Information
Information concerning the Ontario Autism Program (“OAP”), AccessOAP, funding, eligible expenses, provider qualifications and program processes is provided for general guidance only.
Program rules, eligibility, invitations, funding allocations, eligible expenses, reporting requirements and timelines are determined by the Government of Ontario, AccessOAP or another authorized program administrator—not by HolistiCare.
HolistiCare does not guarantee:
- registration, eligibility, invitation or approval under the OAP;
- a particular funding amount or reimbursement decision;
- that every HolistiCare service is an eligible OAP expense;
- that every professional appears on the voluntary OAP Provider List; or
- that program rules or funding structures will remain unchanged.
Families remain responsible for confirming current program requirements and the eligibility of proposed expenses. Official information is available through the Ontario Autism Program and Core Clinical Services pages.
6. Availability, Suitability and Outcomes
Descriptions of a service, program, location or position do not guarantee that it is immediately available.
Availability may depend on:
- individual needs and service appropriateness;
- qualified staff or contractor availability;
- location, schedule and delivery setting;
- clinical supervision or professional authorization;
- confirmed demand, minimum enrollment or operational capacity;
- funding, payment and service-agreement requirements; and
- safety, risk-management and legal considerations.
Results differ between individuals and situations. HolistiCare does not guarantee a specific clinical, behavioural, educational, developmental, employment, funding or other outcome.
Any examples, testimonials or general descriptions are illustrative and do not promise that another person will experience the same result.
7. Forms, Inquiries and Communications
Submitting a contact, inquiry, booking, registration or job-application form authorizes HolistiCare to use the submitted contact information to respond to that request and administer related communications.
Submitting a form does not:
- create a client, patient, professional, employment or contractor relationship;
- guarantee acceptance, enrollment, an appointment, an interview or an assignment;
- guarantee a particular response time;
- constitute emergency or crisis notification; or
- authorize unrelated marketing where separate consent is legally required.
Do not submit detailed medical records, government identification, Social Insurance Numbers, banking information or other highly sensitive information through a general website form or ordinary email unless HolistiCare has requested it and provided an approved method.
Email and internet communications can be delayed, misdirected or intercepted. Visitors are responsible for using accurate contact information and an email account they can access securely.
8. Virtual and Remote Services
HolistiCare may offer virtual, remote or hybrid services where professionally appropriate and operationally available.
Virtual services are governed by separate consent and service requirements. Depending on the service, participants may need:
- a suitable device and reliable internet connection;
- a private and reasonably safe location;
- an authorized adult or support person present where required;
- current location and emergency-contact information; and
- an alternative plan if technology fails or virtual delivery becomes inappropriate.
Technology limitations, outages, interruptions and privacy risks may affect virtual delivery. HolistiCare will take reasonable steps within its control but cannot guarantee uninterrupted third-party internet, device or communication services.
9. Careers and Job Applications
Job postings and application forms may describe current opportunities or permit expressions of interest in anticipated future opportunities.
A posting or application submission does not guarantee:
- a response, interview, assessment or offer;
- employment or independent-contractor engagement;
- minimum hours, clients, assignments or ongoing work;
- a particular compensation or fee within an advertised range; or
- that every position is available under both employee and contractor arrangements.
Any engagement depends on qualifications, professional standing, operational requirements and the actual working relationship. Describing a role as an independent-contractor opportunity does not determine its legal classification.
Applicants must not provide false credentials, professional registrations, work history or authorization information. HolistiCare may verify information at an appropriate stage with consent or other lawful authority.
10. Intellectual Property
Unless otherwise identified, website text, original graphics, branding, logos, layout, downloadable materials, videos and other original content are owned by or licensed to HolistiCare and are protected by applicable intellectual-property laws.
You may view, download or print a reasonable amount of website content for lawful personal, informational and non-commercial use.
Except where permitted by law or written authorization, you must not:
- republish, sell, license or commercially exploit website content;
- use HolistiCare’s name, logo or branding in a way that suggests authorization or endorsement;
- remove copyright, trademark or ownership notices;
- copy substantial portions of the website into another service or database;
- create misleading derivative materials; or
- use automated systems to scrape or extract website content in a manner that burdens the website or violates applicable law.
Nothing in these terms limits rights available under the Copyright Act or another applicable law, including legally available fair dealing.
11. Acceptable Use
When using the website, you must not:
- use it for an unlawful, fraudulent, abusive or deceptive purpose;
- submit information you are not authorized to provide;
- impersonate another person or misrepresent your identity or authority;
- upload malware, malicious code or harmful files;
- attempt to bypass security, access controls or technical restrictions;
- interfere with website operation, availability or another visitor’s use;
- probe, scan or test systems without written authorization;
- collect information about others without lawful authority;
- submit threatening, discriminatory, defamatory or otherwise unlawful content; or
- use website content or forms to harass HolistiCare workers, contractors, clients or other individuals.
HolistiCare may restrict access, block abusive traffic, preserve evidence and report suspected unlawful activity where reasonably necessary.
12. Third-Party Websites and Services
The website may link to government programs, regulators, research, payment services, booking systems, social platforms and other third-party resources.
Unless expressly stated, a link does not mean that HolistiCare controls, sponsors or endorses the third party or guarantees its content.
Third-party websites and services operate under their own terms, privacy practices, accessibility features and security controls. HolistiCare is not responsible for third-party content or practices outside its reasonable control.
Visitors should review the applicable third-party terms and privacy policies before providing information or completing a transaction.
13. Website Operation and Security
HolistiCare uses reasonable measures to operate and protect the website. However, no website or internet transmission can be guaranteed to be continuously available, completely error-free or entirely secure.
HolistiCare may temporarily limit or suspend access for maintenance, security, technical, legal or operational reasons.
Visitors are responsible for maintaining the security of their own devices, browsers, email accounts, networks and login credentials.
If you believe the website has a security or privacy vulnerability, contact HolistiCare privately at info@holisticare.ca. Do not publicly disclose sensitive details before HolistiCare has had a reasonable opportunity to investigate.

15. Limitation of Liability
To the extent permitted by applicable law, HolistiCare and its directors, officers, workers, contractors and representatives are not responsible for losses arising solely from:
- reasonable reliance on general website information instead of obtaining individualized professional advice;
- third-party websites, internet providers, devices or systems outside HolistiCare’s reasonable control;
- website interruption, maintenance or temporary unavailability;
- information submitted through an inappropriate or insecure communication method; or
- unauthorized or unlawful use of the website by a visitor.
This limitation does not exclude or limit liability that cannot lawfully be excluded, including any responsibility imposed by applicable consumer-protection, privacy, professional or other mandatory law.
Website Terms of Use do not limit obligations or remedies established by a separate clinical, educational or other service agreement.

HolistiCare’s collection, use, disclosure, safeguarding, retention and handling of personal information and personal health information are described in the Privacy Policy.
The Privacy Policy forms part of these Terms of Use for website-related information practices. Separate privacy, consent and service documentation may also apply to a clinical, educational, employment or contractor relationship.
17. Accessibility
HolistiCare is committed to respectful and accessible website information and services in accordance with applicable accessibility and human-rights requirements.

Accessibility standards and technical requirements may depend on the organization’s size, the content involved and applicable Ontario law. This statement does not claim a certification or level of compliance that has not been formally verified.
18. General Provisions
Governing law
These website terms are governed by the laws of Ontario and the applicable federal laws of Canada, without limiting any mandatory right or jurisdiction available under applicable consumer-protection or other law.
Severability
If a provision is found invalid or unenforceable, it will be limited or removed only to the extent necessary. The remaining provisions will continue to apply.
No waiver
A failure to enforce a provision immediately does not permanently waive the right to enforce it later.
Assignment
You may not transfer your rights or obligations under these terms in a way that affects HolistiCare without written permission. HolistiCare may transfer website-related rights and obligations as part of a lawful corporate reorganization or business transaction, subject to applicable law.
Relationship to other agreements
These terms constitute the agreement governing general website use. A separate signed service, consent, employment, contractor or other agreement governs its own subject matter. If there is a conflict, the more specific agreement governs that relationship, subject to applicable law.

HolistiCare may update these terms to reflect changes to the website, services, laws or organizational practices. The effective date at the top identifies the current version.
